2. What We Collect

When you join the waitlist:

• Email address
• Signup timestamp and source page

When you use the HyperPulse app (after launch):

• Account information: name, email address, athlete name and age (parent-provided)
• Motion and performance data from the wearable sensor: acceleration, angular velocity, and derived athletic metrics such as estimated speed, distance, sprint count, jump height, work rate, and load
• Device identifiers and app usage data
• Subscription and purchase information (processed by Stripe — we do not store full card numbers)

What we do NOT collect:

• Audio or video from the athlete or surroundings
• GPS location
• Medical records, diagnosis data, treatment data, or clinical health data
• Biometric identifiers such as fingerprints or facial recognition

3. How We Use Your Data

• To process waitlist signups and send order and shipping communications
• To provide the HyperPulse app and display performance data to the registered parent/guardian
• To process subscription payments
• To improve the HyperPulse product (aggregated, de-identified analytics only)
• To send product updates and offers — you may opt out at any time

We do not sell your data. We do not use your data for advertising networks. We do not share your data with third parties except as necessary to operate our services (Supabase for database, Stripe for payments, SendGrid for email).

4. Data Retention

• Waitlist emails: Retained until you request deletion or we launch commercially, whichever comes first
• Performance data: Retained for the duration of your active subscription plus 30 days after cancellation
• Texas residents: Biometric-derived performance data is deleted after 1 year in compliance with Texas data retention requirements
• To request deletion of your data at any time, email [email protected]

5. Children's Privacy (COPPA)

HyperPulse is designed for use by youth athletes, with data provided to and managed by a parent or legal guardian. We comply with the Children's Online Privacy Protection Act (COPPA) and applicable FTC rules.

For athletes under 13:

• The account must be created by and registered to a parent or legal guardian (not the child)
• We require verified parental consent before any data is collected from or about a child under 13
• Parental consent is obtained before collection through the account activation and sensor-use acknowledgment flow
• Parents may review, correct, or delete their child's data at any time by contacting us at [email protected]
• We do not use advertising SDKs, analytics trackers, or third-party data sharing for accounts involving children under 13
• We do not condition a child's participation in any activity on providing more personal information than is reasonably necessary

If you believe we have inadvertently collected information from a child under 13 without parental consent, contact us immediately and we will delete it within 72 hours.

6. California Residents (CCPA)

California residents have the right to: know what personal information we collect and how it is used; request deletion of their personal information; opt out of the sale of their personal information (we do not sell personal information); and not be discriminated against for exercising these rights.

7. Illinois Residents and Sensitive Data

We do not intentionally collect biometric identifiers such as fingerprints, voiceprints, retina or iris scans, or face/hand geometry. Because athlete movement and performance data can still be sensitive, we treat it with heightened care: parent-managed consent, limited collection, restricted access, no sale of athlete data, and deletion on request subject to legal retention requirements.

8. Security

We use industry-standard security measures including encrypted transport, secure payment processing, and access controls limiting who can view user data. No system is 100% secure. If you discover a vulnerability, please report it to [email protected].

9. Cookies

Our website uses minimal first-party cookies for session management. We do not use advertising cookies, third-party tracking pixels, or behavioral analytics. You can disable cookies in your browser settings without affecting your ability to use our site.

10. Changes to This Policy

We will notify registered users by email of material changes to this policy before they take effect. Continued use after the effective date constitutes acceptance of the updated policy.
